Terms of service
Draft for legal review. Not in force. Last updated: [date of publication]
These terms are an agreement between you and [Company] ("Trailcam", "we") for your use of Trailcam, the service at app.trailcam.dev that runs mobile apps' journeys on simulators and emulators, on every build and on a schedule, and records each run. If you use Trailcam for an organization, you agree for it and confirm you can.
1. Accounts and workspaces
- You need an account, with an email address you control. You sign in with a code sent by email, Google, GitHub or a passkey. Keep your sign-in methods secure; tell us at once at support@trailcam.dev if you think someone else has used your account.
- A workspace holds a team's projects, flows, builds and runs. Its Owners manage its people, plan and settings, and are responsible for who they invite and for the workspace's use of Trailcam.
- You must be at least 16, and able to agree to these terms.
- CI keys let your build systems use Trailcam for one project. Treat them as passwords: anything done with a key is done by its workspace.
2. What you put in Trailcam
- Your content is what you and your workspace put in or produce with Trailcam: builds of your apps, flows, test data in them, and the recordings, screenshots and logs of your runs. You keep all rights to it.
- You give us the rights we need to run the service with it: to store it, run your builds and flows on our devices, record the runs, show the results to your workspace, and (if Trailcam AI is on) have it read as described in section 5. We don't use your content for anything else, and we don't sell it.
- You confirm you have the right to upload and test each app and build you give us, and that running it on our devices won't break any law or anyone's rights.
- Use test data. Flows run on emulated devices whose screens are recorded. Don't put real people's personal data, real payment details or production secrets in flows or test accounts; use test accounts and test cards. If personal data does reach Trailcam, our data processing agreement covers how we handle it.
3. Acceptable use
Don't use Trailcam to:
- test apps or services you aren't allowed to test, or run flows against someone else's systems without permission;
- run builds that are malicious, try to break out of their device, reach our or other customers' systems, or harm anyone (we check each host for this and may stop any run that tries);
- send load or traffic meant to disrupt any service, including through flows run on a schedule;
- mine cryptocurrency, send spam, or do anything illegal;
- get around plan limits, rate limits or security measures, or share an account to avoid paying for a plan;
- copy or resell Trailcam, or build a competing service from it.
We may suspend a workspace or account that breaks these rules, ideally after telling you and giving you a chance to fix it; at once if it puts others at risk.
4. Plans, billing and changes
- Plans are priced by runs a month, as listed at trailcam.dev/pricing when you choose them. A run is one flow on one platform that passed, failed, or was stopped after it started, and counts once for every 3 minutes its flow takes; runs that couldn't run are free. The Free plan includes a number of runs each month per person who owns Free workspaces, and some limits; paid plans include more runs, and runs past a paid plan's are charged at the listed rate per 1,000 at the end of the billing month.
- Billing is through Stripe, monthly or yearly in advance, in US dollars, plus applicable taxes. Plans renew automatically until cancelled.
- Upgrades take effect at once, with the price difference prorated. Downgrades and cancellations take effect at the end of the period already paid for; until then the workspace keeps its plan.
- Failed payments: if a renewal can't be charged after Stripe's retries, the workspace keeps its data but works within the Free plan's limits until the invoice is paid.
- Refunds: fees are non-refundable, except that deleting a paid workspace refunds the unused part of the period (after any extra runs are billed), never more than was paid for that period, and except where the law requires.
- Price changes apply from your next billing period after at least 30 days' notice by email.
5. Trailcam AI
- Trailcam AI is a set of features that use AI models: explaining why a run likely failed, suggesting fixes to flows, writing flows from a journey you describe, checking how screens look, and the AI commands your flows can use.
- To do this, it reads your runs' logs, screenshots and the screens' element trees, and your flows. Models run on Cloudflare Workers AI [and, where a feature uses it, Anthropic's Claude through Cloudflare]; no model is trained on your content, by us or by them.
- It's on by default; a workspace's Owners can turn it off at any time in workspace settings.
- Its output is advice. Diagnoses and suggestions can be wrong. They never change a run's result, and a suggested fix is only ever tested or saved when someone in your workspace chooses to. Check what it suggests before relying on it.
6. The service
- We work to keep Trailcam running and your production checks on time, and publish its status at status.trailcam.dev. But Trailcam is provided as is: we don't promise it will be uninterrupted or error-free, or that it will catch every problem in your app. [No service level agreement applies unless agreed in writing.]
- We may change Trailcam, adding or removing features. If we remove something you pay for, we'll tell you in advance and, if it matters to you, you may cancel and get a prorated refund.
- Recordings, screenshots and logs are kept for as long as your plan says, then deleted. Download what you need to keep.
- You can export your workspace's data at any time (Owners, workspace settings) and your own (account settings).
7. Ending
- You can delete your workspace or your account at any time in settings. Deleting a workspace erases its data at once and its files soon after; deleting your account deletes the workspaces only you are in.
- We may end these terms for a workspace or account that seriously or repeatedly breaks them, with notice where we can.
- If we stop offering Trailcam, we'll give at least 60 days' notice, time to export your data, and a refund of fees paid for time after it stops.
8. Confidentiality and security
We keep your content confidential and protect it as described in our privacy policy and data processing agreement: each run on its own throwaway device, encryption in transit, keys and secrets sealed at rest, and workspaces kept apart in our database. Tell us about security issues at [security contact].
9. Warranties and liability
- Disclaimer. Apart from what these terms say, Trailcam is provided without warranties of any kind, express or implied, including merchantability, fitness for a purpose and non-infringement, to the extent the law allows.
- Limit. Neither of us is liable for indirect, incidental, special, consequential or punitive damages, or lost profits, revenue or data, even if told they were possible. Each side's total liability under these terms is limited to the fees you paid us in the 12 months before the claim [or $100, if more]. [These limits don't apply to your payment obligations, your indemnity below, or either side's gross negligence or wilful misconduct.]
- Indemnity. You'll defend and indemnify us against third-party claims arising from your content, your apps, or your use of Trailcam against these terms.
10. General
- Changes to these terms: we'll email Owners at least 30 days before a change that reduces your rights takes effect. Continuing to use Trailcam after it does means you accept it.
- Governing law: [governing law and venue].
- Notices to you go to your account's email; to us, to [legal contact].
- These terms, the privacy policy and the DPA are the whole agreement about Trailcam. If part of them can't be enforced, the rest still applies. Not enforcing something isn't giving it up. You can't transfer these terms without our agreement; we may to a successor of our business, with notice.
